DJ AM Defends His Lawsuit in His Blog

DJ AM has come under scrutiny after announcing his airline company lawsuit. Many people assumed he was going to go after the pilots themselves, which would affect their families. But AM insists it couldn’t be farther from the truth, and that he won’t be trying to take any money from either of their estates.

Last week TMZ reported: DJ AM is suing the estates of the two pilots who died in the crash as well as Clay Lacy Aviation, Global Exec Aviation, Inter Travel & Services Inc, Goodyear Tire and Rubber Co, and Learjet.

In his lawsuit, DJ AM claims when the pilots reached takeoff speed, they knew shit was going down after one of the tires blew out. Instead of taking off, the pilots decided to quit the takeoff, causing the plane to crash and burst into flames. The suit says this was a bad decision made by the pilots.

But here’s what Adam is saying now about the truth of his lawsuit. It’s actually very touching. And what most people forget is that he does have to live with the guilt that he survived, when most of the people on that jet died.

Hello All -

Normally I don't feel like I NEED to make a statement like this, but after I read some recently reported untruths I feel like I have to. I want to take a second to address the hurtful posts and clear up any misunderstandings any of you may have about my law suit. I would NEVER sue the deceased pilots' estates or personal holdings. I am more than grateful that I survived this horrible accident and I'd never try to take anything from those that didn't. Despite the misinterpretations of the lawsuit, this suit is against the insurance companies that insured the pilots. I'm not after Sarah's or James' personal estates nor their property. Everyone involved in this suit has suffered a great deal, and I would not do anything to make matters worse for the deceased family and friends. Daily I live with the guilt and grief of what happened that night, what I saw, who was lost and why I was spared. I have no words to express the pain that comes with knowing four people died, while I lived.

As a pilot, I can assure you it is the pilots fault period. Pilots are trained that when the plane reaches V1 speed, the hand comes off the throttle and goes on the yoke, you then take off NO MATTER WHAT HAPPENS. It takes almost a mile to stop a jet at V1 with a blown tire, it takes only 1000' to take off. So unless you are on a 3 mile long runway, there is no choice but to go. The pilot made the fatal decision to go against EVERY BIT of his training and everyone suffered.
