Chris Brown's attorney is looking to delay next Monday’s preliminary hearing. Mark Geragos entered an appeal to the California Supreme Court in hopes to stall the case.

According to Reuters, Geragos wants the court to rule on the photograph of Rihanna that leaked from the LAPD.

Back in May, Superior Court judge Patricia Schnegg denied the request, saying it was too early in the case to address the issue.

Most likely, the hearing will go on as planned, and Rihanna and Chris will both be present.

During Monday's hearing, the judge will decide whether there is enough evidence to go to trial. The California Supreme Court must first accept the case, and if it does, it could make a decision at any time.

UPDATE:
According to Us Weekly, the California Supreme Court denied a request to delay an upcoming hearing in the case of the Chris Brown.

Despite Chris’ lawyer seeking a delay today, the court posted the decision to keep the hearing as scheduled. It is set for Monday in downtown L.A.
