We don’t know about you but we are sick of Anna Nicole Smith’s ongoing drama. There are reports today that Photographer Larry Birkhead, who claims to be the father of Anna Nicole Smith's newborn daughter, Dannielynn Hope, has filed papers in a California court to establish paternity and obtain legal custody of the child, USA Today reports. Birkhead's publicist released a statement on Monday to say he's retained the services of celebrity attorney Debra Opri, whose past clients included James Brown.
The rep also said that Smith has been served with papers in the Bahamas, where last week she held a commitment ceremony with her attorney, Howard K. Stern, who also claims to be the baby's father...there’s greed written all over this!
Think about this one, if Anna finally gets her settlement from her ex billionaire husband that she’s been fighting for, the baby’s real daddy is probably gonna get a nice chunk! It’s sad that there’s a child involved in all this chaos, too bad Momma’s a gold digging biyatch. No real mother would sell the last photographes of her son for a quick buck and then get 'married' before he's even been put to rest.
Birkhead "seeks truth in paternity as he believes beyond any doubt that he is the father and seeks a presence in this child's life," Opri told USA Today. "He is concerned for the health and safety of the child based upon drug issues and manipulation by a third party for purposes contrary to the interests of the child."
Stern told Larry King Live on Sept. 26 that he had loved Anna Nicole "for quite some time," and said that "based on the timing of it, there shouldn't be a doubt" that he is the baby's father.
In his petition Birkhead also requested that Smith and her daughter undergo drug testing. According to the photographer's attorney, Debra Opri, Birkhead is seeking legal and physical custody of the child.
Smith's ex also accused her of fleeing to the Bahamas to have her baby to avoid being tested for drugs. Birkhead further alleged that Stern is claiming that he is Dannielynn's father for his own financial gain--and that Smith had asked a third man to claim he was the father of her child, only the plan didn't work out because the man in question had already had a vasectomy.
Opri, meanwhile, called Birkhead "a first-time father" who is "responding to allegations made by [Stern]" and "believes beyond any doubt that he is the father."
"There is absolutely no way that [Stern] is the father of this child," Birkhead said. "He knows it, I know it and that's all there is to it. He challenged me on live television to get an attorney, so I have taken him up on his offer."
